These Terms of Service ("Terms") govern your access to and use of the website avilestechnologies.com (the "Site") and any related services, products, features, or content (the "Services") provided by Aviles Technologies LLC, a Florida limited liability company ("Aviles Technologies", "we", "us", or "our"). By accessing the Site, submitting a contact form, or opting in to receive communications from us, you agree to these Terms. If you do not agree, do not use the Site or the Services.

Aviles Technologies offers AI-powered marketing automation services for small businesses, including AI-driven lead follow-up, appointment reminders, review requests, and re-engagement campaigns delivered over SMS, email, and other messaging channels. We provide the Services to business clients who, in turn, communicate with their own opted-in customers.

3. SMS / Text messaging terms

By providing your mobile phone number and checking the SMS opt-in box on our contact form (or otherwise expressly opting in), you consent to receive recurring SMS / text messages from Aviles Technologies LLC at the mobile number you provided. The categories of messages may include marketing, informational, and account-related messages.

Message frequency

Message frequency varies based on your interaction with us or with one of our clients. You may receive up to several messages per week. We do not send autodialed marketing messages to anyone who has not opted in.

Costs

Message and data rates may apply, depending on your mobile carrier and plan. Aviles Technologies LLC is not responsible for any charges from your wireless carrier.

Opting out

You can stop SMS messages at any time by replying STOP to any message we send. After you reply STOP, you will receive a single confirmation message and will not receive further SMS messages from us unless you opt in again.

Supported carriers

Major carriers (including AT&T, T-Mobile, Verizon, Sprint, and others) are supported. Carriers are not liable for delayed or undelivered messages.

Your information is handled in accordance with our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of SMS opt-in data — including mobile phone numbers and consent records — are excluded from any third-party sharing.

Our total aggregate liability arising out of or related to these Terms or the Services shall not exceed one hundred U.S. dollars (USD $100) or the amount you paid us in the twelve (12) months preceding the claim, whichever is greater.

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction in those courts.
